Land Disturbance Permit Application Process

If you wish to submit a Land Disturbance Application to the City of Hendersonville, please visit the Hendersonville Citizen Self Service (CSS) Portal at https://css.hvilletn.org. The applicant will create an account and complete the application process through CSS.  The Hendersonville CSS- How to Register (PDF) provides step by step instructions to create an account.  The CSS- How to Apply Online (PDF) provides step by step instructions on how to apply for a permit.  There is a $50 application fee that must be paid during the application process.  

  • Contacts for Owner, Contractor, Engineer, Project Manager, Emergency Contact, and Erosion Control Specialist (if applicable)
  • Approved Site Plans/Construction Plans
  • Stormwater Pollution Prevention Plan (SWPPP)
  • TDEC Notice of Coverage (if applicable)
  • Other Applicable Permits (e.g., ARAP, TVA, USACE, MSGP, etc.)

LDP Process

Land disturbing activities means any activity on property that results in a change in the existing soil cover (both vegetative and non-vegetative) and/or the existing soil topography. Land disturbing activities include, but are not limited to, development, re-development, demolition, construction, reconstruction, clearing, grading, filling, trench, and excavations.

The City of Hendersonville passed a revised Stormwater Ordinance on September 10, 2024.  The City hosted a professional development workshop to review the ordinance changes and updated operating procedures as a result of those changes.  City stormwater staff also reviewed the enforcement process for municipal code violations.  The City recommends viewing the workshop for in depth guidance on the permitting process from breaking ground to closeout.  

Land Disturbance Surety

A land disturbance surety will be required for all commercial/industrial properties and residential developments. The land disturbance surety is $10,000/acre (rounded up). Example: Project site is 2.4 acres of disturbance (3 acres x $10,000= $30,000) the surety amount is $30,000.

Land Disturbance Surety Release Process

At project completion, the City requires submittal and approval of the following documents prior to the release of the Land Disturbance Surety:

  1. Notice of Termination from TDEC
  2. Professional Engineer Permanent SCM Certification Form
  3. As-Built Plans 
  4. Hendersonville Asset Management Workbook
  5. Stormwater Inspection and Maintenance Agreement/Long-Term Maintenance Plan (IMA/LTMP)
  6. W-9 (if LD surety was provided in cashier’s check)
  7.  Provide Post-Construction Stormwater Permit Contacts
  8.  Issue Post-Construction Permit
